CFPB's First Director, Rich Cordray, Publishes "Watchdog"

The CFPB's first director, Rich Cordray, has published a book, "Watchdog," explaining efforts to set up and run the Consumer Financial Protection Bureau. I recommend reading the book! The new agency was established as part of the Wall Street Reform and Consumer Protection Act of 2010, enacted after light regulation of reckless Wall Street bank practices led to the financial collapse of 2008 and the ensuing Great Recession. Under Cordray's tenure, the CFPB returned over $12 Billion to over 31 million consumers harmed by big banks, payday lenders, for-profit schools, debt collectors and credit bureaus. 

Half of CFPB Complaints in 2019 About Credit Reports As House Brings Reforms To Floor

On Wednesday, the full U.S. House is expected to vote on a credit reporting reform package, HR 3621, the Comprehensive CREDIT Act. Meanwhile, a PIRG analysis finds that half of all complaints to the CFPB in 2019 concerned credit reporting and the most-complained about companies, in the entire database, were the so-called  Big 3 credit bureaus.

U.S. PIRG and Leading Groups Support Findings of Norwegian Privacy Report

In support of a report by colleagues from the Norwegian Consumer Council on whether the data sharing and privacy practices of a number of dating and other smartphone apps were in compliance with European privacy rules (GDPR) or the new California Consumer Privacy Act (CCPA), U.S. PIRG and other leading groups sent joint letters to key policymakers, including the California, Oregon and TexaS Attorneys General, the Federal Trade Commission and all members of the U.S. House and Senate. 

CFPB Appoints Task "Farce" On Consumer Law

Last week, CFPB Director Kathy Kraninger appointed four lawyers and professors to a "Taskforce on Federal Consumer Law." To my knowledge, none have worked for consumer protection organizations yet all have worked as industry consultants or been aligned with industry views, although all have previous government experience. I am aware of several distinguished professors with CFPB experience who were rejected. Incredibly, the announcement of this better-described "Task Farce" claimed inspiration from a distinguished bi-partisan commission established by the Consumer Credit Protection Act in 1968." 

The credit reporting system is backwards. Congress can pass one law to fix two things about it.

Last week, Sens. Jack Reed (RI) and Chris Van Hollen (MD) introduced legislation to finally give consumers real control over our own credit reports. The Consumer Credit Control Act would change what Sen. Reed appropriately calls our “backwards” credit reporting system by helping to solve two problems. The Consumer Credit Control Act is a win-win for consumers. It improves their privacy and saves them money.

Recently, the CEOs who make up the Business Roundtable renewed their demand that Congress pass a federal privacy “standard” that preempts stronger state laws. House Committee Takes Actions To Clean Up Credit Bureau Mistakes

In committee votes this week and last week, the House Financial Services Committee sent a package of credit reporting reforms on to the House floor. It's the first major Congressional action to rein in the so-called Big 3 credit bureaus - Equifax, Experian and Trans Union - and other smaller, specialized bureaus and credit scoring companies, since 2003. The Big 3 national credit bureaus have been the most complained about financial firms to the CFPB for four years running, predating the massive Equifax data breach.

As CFPB Reviews Overdraft Rules, UK Regulator Makes Pro-Consumer Changes

As the CFPB conducts a ten-year regulatory review of the Overdraft Rule established by the pre-CFPB regulators in 2010, the UK's Financial Conduct Authority has announced sweeping changes to address what it calls a "dysfunctional" overdraft market. The US system prohibits overdraft fees on debit and ATM transactions unless you opt-in to fee-based "standard overdraft protection," but the fees average over $32 per overdraft and CFPB has accused some banks of deceptive marketing of the service. Meanwhile, the UK's FCA is banning fixed fee overdrafts and requiring UK banks to treat overdrafts as loans subject to reasonable interest rates. We've asked CFPB to ban overdrafts on debit and ATM transactions.
